Last night the Federal Motor Carrier Safety Administration (FMCSA) issued a Regional Emergency Declaration (click to download) in response to the ongoing heating and fuel shortages from severe winter storms in the affected states. The Declaration exempts companies and drivers from the driver hours of service and other rules in 49 CFR 390-399 except as specifically noted.
Drivers who are transporting persons, supplies, goods, equipment, heating fuels, including heating oil, propane, natural gas, and other fuel products, including gasoline, in direct response to the weather emergency may exceed the hours of service limits in 49 CFR Part 395 while they are providing direct assistance to the emergency in: Arkansas, Connecticut, Delaware, District of Columbia, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Massachusetts, Minnesota, Mississippi, Missouri, Montana, Nebraska, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Dakota, Tennessee, Texas, Virginia, West Virginia, Wisconsin and Wyoming.
The exemption lasts through March 4, 2021 or until the emergency is declared over, whichever is sooner.
