MANUFACTURERS GROUP ISSUES
BULLETIN ON ULSD SAFETY
The
Association
of
Equipment
Manufacturers (AEM) recently issued
a bulletin that provides members with
industry-driven end-user guidance on
safely refueling with Ultra-Low Sulfur
Diesel (ULSD). The bulletin explains that
the removal of sulfur and other compounds
in ULSD fuel decreases the fuel’s conduc-
tivity and increases its ability to store static
charge. “Static electricity discharge when
combustible vapors are present could result
in a fire or explosion,” the bulletin notes.
The bulletin urges industry workers
to consult with their fuel or fuel system
supplier to ensure the delivery system is
in compliance with fueling standards for
proper grounding and bonding practices.
AEM is encouraging industry groups and
government entities to disseminate the bul-
letin to foster widespread understanding of
the related risks during ULSD refueling.
“About 90 percent of off-road equip-
ment is run on diesel and at one time the
fuel had upwards of 5,000 ppm sulfur con-
tent compared with 15 ppm today,” stated
Mike Weber, AEM technical and safety
services manager. “ULSD is now required
for on-highway and off-highway applica-
tions in the North American market and we
need to educate users who may be unaware
of the changes in the physical properties of
ULSD and the potential for harm during
refueling.”
CFTC FILES ENFORCEMENT
ACTION AGAINST MF GLOBAL
The U.S. Commodity Futures Trading
Commission (CFTC) recently filed an
enforcement action in the United States
District Court for the Southern District of
New York against MF Global Inc., a regis-
tered futures commission merchant (FCM);
MF Global Holdings Ltd. (Holdings),
former Chief Executive Officer of MF
Global and Holdings Jon S. Corzine, and
former Assistant Treasurer of MF Global
Edith O’Brien based on, among other viola-
tions, MF Global’s unlawful use of customer
funds that harmed thousands of customers
and violated fundamental customer protec-
tion laws on an unprecedented scale.
MF Global has agreed to settle all
charges against it on terms set forth in a
proposed order that is subject to court
approval and includes 100 percent restitu-
tion of the approximately $1 billion lost by
all commodity customers when the firm
failed on Oct. 31, 2011. Commissioner
Jill Sommers stated, “I am pleased that
the MF Global Trustee has agreed to settle
the charges against the company. There is
nothing more important than doing every-
thing possible to make full restitution to all
commodity customers.”
According to the Complaint, Corzine,
a former U.S. Senator and New Jersey
Governor with more than 20 years of Wall
Street experience, joined MF Global as CEO
in March 2010 with a plan to transform the
firm from a futures broker into a major
investment bank. Corzine’s strategy called
