Court, the proposed settlement of all charges
against MF Global will require 100 percent
restitution of all remaining commodity
customer claims. The proposed order also
includes the imposition of a $100 million
penalty, which can be paid to the extent MF
Global has not fully exhausted all available
funds and assets paying customers and then
other creditors entitled to priority under
bankruptcy law.
MASS. LAWMAKERS PROPOSE
FIRST STATE CARBON TAX
Two state legislators in Massachusetts
recently proposed a new carbon tax that
would be levied on both gasoline and
heating oil, according to recent published
reports. It would be the nation’s first state
carbon tax. Rep. Tom Conroy (D-Wayland)
and Sen. Michael Barrett (D-Lexington)
have proposed to tax carbon at $5 per
metric ton. The bill would also add new
taxes on gasoline, heating oil and firewood,
though the lawmakers say much of col-
lected tax revenue under their proposal
would be given back to taxpayers through a
proposed doubling of the personal income
tax exemption and other measures.
OIL HEAT CARES ASSISTS NYC CHURCH
DAMAGED IN SUPERSTORM SANDY
Technicians and service managers
representing the Oil Heat Cares program
last month replaced heating equipment in a
New York City church that was damaged in
2012 by Hurricane Sandy.
Angel Gonzalez, a Petro Service
Manager who is very active in the National
Association of Oil & Energy Service
Professionals (OESP), and many colleagues
performed the work at Christ by the Sea
Presbyterian Church in Queens, N.Y. They
installed a four-zone hydronic boiler, a 275-
gallon oil tank and approximately 300 feet
of baseboard in the church. OESP members
from the Garden State, Fairfield County,
New York City and Long Island chapters
contributed their time to the project.
OESP extended thanks to many
organization and individuals for their con-
tributions to the effort: Peerless boiler for
donating the boiler package; Roth for Pex
tubing, fittings and the oil tank; Petro for
the oil tank and contributions of labor; Taco
for the controls, valves and circulators; Gil
Meyerowitz, for pipes and fittings; Sippin
Energy for pipes and fittings and use of an
installation truck; Blackman Supply for the
baseboard; and Guaranteed Chimney for
work on the chimney.

should have known of the deficiencies in its
customer accounts; filed false reports with
the CFTC that failed to show the deficits in
the customer accounts; and used customer
funds for impermissible investments in
securities that were not considered readily
marketable or highly liquid in violation of
CFTC regulation; and that Holdings con-
trolled the operations of MF Global and is
therefore liable as a principal for MF Global’s
violations of the Commodity Exchange Act
and CFTC regulations.
