Please read the below description and take note of the fact that there are two separate regions (NEMA vs. Non-NEMA) with different requirements.

Not For Trucks
REQUIRED FOR ALL DISPENSERS BY EPA REGULATIONS (40 CFR 80)

The next phase of the federal transition to ULSD 15-ppm diesel fuel began June 1, 2010 for refiners. This means that downstream marketers must affix new diesel fuel sulfur content labels to their dispensers later this year. New kerosene and locomotive /marine sulfur content labels are required as well. The compliance deadlines for affixing the new labels are as follows:

-October 1, 2010 for non-road diesel fuel, kerosene, locomotive and marine dispensers.

-December 1, 2010 for highway diesel fuel and kerosene labels

The new labels may be affixed as early as June 1, 2010 so long as the sulfur content of the diesel fuel dispensed matches the label on the dispensers.

IMPORTANT! The EPA requires different labels for the NEMA and NON-NEMA areas. The six New England States are located in the NEMA area and must use the NEMA dispenser labels (see NEMA and NON NEMA areas defined below).

IMPORTANT! The EPA sulfur content labels do not replace IRS diesel fuel and kerosene tax status labels. Both the EPA and IRS labels are required. To order the IRS labels visit www.nefiactionceter.com.

IMPORTANT! The EPA sulfur content and IRS tax status labels must also be affixed to portable skid tanks. Labels are not required for trucks.

IMPORTANT! While the sulfur content of heating oil is not regulated under the EPA desulfurization program, heating oil dispensers are required to be labeled.

****The EPA has approved multiple language options for these labels. We have chosen one set of language options but there are others that meet EPA standards.

NEMA (Northeast/Mid-Atlantic)Area: The following states and counties are located in the NEMA area: all six New England states; New York state (except for the counties of Chautauqua, Cattaraugus, and Allegany); New Jersey; Delaware; North Carolina; Virginia; Maryland; District of Columbia; Pennsylvania (except for the counties of Erie, Warren, Mc Kean, Potter, Cameron, Elk, Jefferson, Clarion, Forest, Venango, Mercer, Crawford, Lawrence, Beaver, Washington, and Greene); and the eight eastern-most counties of West Virginia (Jefferson, Berkeley, Morgan, Hampshire, Mineral, Hardy, Grant, and Pendleton).
NON-NEMA Area: Everywhere else. The EPA regulations do not apply to California.
