Below is the official statement of Sean Cota, President & CEO of NEFI on the tragic natural gas explosions that occurred in the City of Lawrence and towns of Andover and North Andover, Massachusetts: “NEFI members and supporters across New England and the broader Northeast are devastated by this tragedy. Our thoughts and prayers are with the victims, especially the family and friends of the young man who lost his life in the incident. We praise the heroic efforts of first responders, law enforcement and area residents in dealing with this unprecedented crisis. NEFI has reached-out to our industry partners at the state, regional and national levels to offer our assistance as needed. “State and federal authorities have begun their investigation into the cause of the incident. However, as Massachusetts Governor Charlie Baker said, culpability will come in time. Right now we should focus on the safety of the communities affected by this horrible, yet very likely preventable, natural gas incident.” NEFI believes the need to reinforce public safety extends to heating oil and propane customers. We recommend that heating oil retailers communicate that such an event would never happen to their customers. They should be reminded that heating oil, whether conventional or biofuel-blended, is an extremely safe fuel and at no risk of causing an explosion....

CSVA ANNUAL BRAKE SAFETY WEEK IS SEPTEMBER 16-22 The Commercial Vehicle Safety Alliance (CSVA) will conduct its annual Brake Safety Week September 16-22. CVSA is an alliance of federal, state and local commercial motor vehicle enforcement authorities that conducts several coordinated nationwide roadside inspection enforcement actions each year. Last year, as you may recall, CSVA condensed its brake inspection blitz into a single Brake Safety Day. This year, however, the brake inspection period will again last a full week. Most inspections performed during this period will be complete North American Standard Level I Inspections, but inspectors are likely to pay special attention to brake-system components. "Vehicles with defective or out-of-adjustment brakes will be placed out of service," CSVA writes. Commercial motor vehicle owners and fleet operators can prepare their trucks for the inspection by correcting brake issues related to the following, before September 16: Loose or missing parts Air or hydraulic fluid leaks Defective rotor conditions Measurement of pushrod travel Mismatched air chamber sizes across axles Air reservoir integrity and mounting Worn linings, pads, drums or rotors Required brake-system warning devices Other brake-system components In addition, fleet operators should ensure compliance with all of the items checked under a normal Level I inspection. (Review those here.) Last year, 14 percent of all trucks inspected during the one-day brake inspection blitz were placed out of service for brake-related violations. Earlier this year, during an unannounced Brake Safety Day, 1,595 commercial motor vehicles were removed from service for brake violations (13.8% of 11,531 inspections across the U.S. and Canada). These violations are also usually the primary reason for vehicles being placed out of service during CSVA’s International RoadCheck inspection blitz, as was the case last year. NEFI members should be on the lookout for stepped up roadside inspections of trucks and drivers over the next several days. The annual inspection blitz, known as "RoadCheck" and organized by the Commercial Vehicle Safety Alliance (CVSA), is a joint effort by state and federal motor carrier enforcement officers nationwide. RoadCheck is an annual 72-hour event in which inspectors fan out to conduct roadside inspections, looking for compliance with the FMCSA's driver and truck safety requirements....

Senators Grassley (R-IA) and Cantwell (D-WA) have reintroduced legislation to extend the biodiesel tax credit for three years and move it upstream from blenders to producers, called the "American Renewable Fuel and Job Creation Act" (S.944). While NEFI strongly supports an extension of the biodiesel tax credit, the region's heating fuel marketers have warned that a producers-only tax credit would disadvantage biodiesel imports from Canada and other trade partners and cause supply disruptions and higher consumer prices for biodiesel and Bioheat(R) Fuel. NEFI is reviewing this legislation and discussing next steps....

Congress successfully averted a government shutdown by approving a $1.1 trillion omnibus spending bill (H.R.244) that funds federal agencies and programs through the remainder of the current fiscal year, ending September 30, 2017. NEFI members should be aware the bill does not eliminate $372 million in remaining Low Income Home Energy Assistance Program (LIHEAP) funds as requested by the President. Trump's proposal to eliminate the federal LIHEAP program has been met with strong opposition in Congress....

Representatives of NEFI participated in last week's New England Council (NEC) Annual Conference in Washington, DC. The NEC is a non-partisan alliance of "businesses, academic and health institutions, and public and private organizations throughout New England formed to promote economic growth and a high quality of life in the New England region." The organization is both non-profit and non-partisan, and provides regular opportunities for its members to engage members of Congress and key federal regulators. Two additional bills have surfaced that would retroactively renew the $1 per gallon federal biodiesel tax credit, which expired on December 31, 2016. The first is a companion bill to legislation offered in the Senate last week, known as the "American Renewable Fuel and Job Creation Act." The House bill (H.R.2383), offered by Reps. Kristi Noem (R-SD) and Bill Pascrell (D-NJ), is identical to the recently introduced Senate bill (S.944). Both bills would extend the biodiesel tax credit for three years and move eligibility from blenders to U.S. producers....
