EPA Proposes Rollback Of GHG Reporting Rules

The Environmental Protection Agency has proposed amending the Greenhouse Gas Reporting Program (GHGRP) to remove program obligations in 40 CFR Part 98 for most source categories, including the distribution segment of the petroleum and natural gas systems source category (subpart W–Petroleum and Natural Gas Systems), and suspend program obligations for the remaining subpart W segments until reporting year 2034.

The GHGRP requires reporting of greenhouse gas data and other relevant information from large GHG emission sources, fuel and industrial gas suppliers, and CO2 injection sites in the United States. According to the EPA, 47 source categories comprising approximately 8,000 facilities are required to report their emissions annually, and the reported data are made available to the public in October of each year.

EPA Administrator Lee Zeldin announced the proposed rollback and said it would save American businesses up to $2.4 billion in regulatory costs while maintaining the agency's statutory obligations under the Clean Air Act. Unlike other mandatory information collections under the CAA, Zeldin said the GHGRP is not directly related to a potential regulation and has no material impact on improving human health and the environment. The requirements are simply intended to shine light on industries and facilities that emit GHG and allow environmental groups to apply political pressure to curtail their activities.
