NPGA has announced a major, unprecedented win for the propane industry: on Monday the United States Supreme Court granted its case challenging the furnace rule and vacated the judgment of the D.C. Circuit. The result is that the Biden-era’s U.S. Department of Energy’s furnace rule is eliminated. The challenge to this rule was a joint collaboration between NPGA and other gas groups.
The now-eliminated DOE rule would have mandated 95% AFUE on all furnace sales by the end of 2028. Without this victory, all non-condensing propane furnace sales in the US would have been eliminated as no existing non-condensing propane furnace could have complied.
In a 56-word opinion, the Supreme Court also cited the brief filed by the United States Solicitor General in NPGA’s favor. NPGA started the Legal Action Committee three years ago with the goal to harness the power of the courts in exactly this way to fight for our industry. Today is a great day for the industry, and the fight continues in courts throughout the country - hopefully with this much success.
